A case challenging the TennCare limits on home health care and private duty nursing

Twenty people who rely on TennCare home health services have filed suit, asking a federal court to stop the TennCare home health cuts on an emergency basis. The plaintiffs contend that the cuts violate the Americans with Disabilities Act.

Updates

12/23/08 - The Court ruled on behalf of the plaintiffs, upholding a preliminary injunction. Read the Legal Aid Society press release here. Read the Court's ruling here.

11/07/08 - The preliminary injunction hearing concluded today with Judge Haynes stating that he would rule as soon as possible. Four named plaintiffs gave compelling testimony about the impact of the home health limits. Plaintiffs counsel requested relief for the 22 named plaintiffs in the form of individualized assessments and provision of services that would adequately meet their needs. As more information becomes available it will be posted here.

10/30/08 - The preliminary injunction hearing in this federal court case is scheduled for Friday, November 7, 2008, at 9:00 a.m.  The Honorable William J.
